Getting arrested for drug possession hurts. It can be humiliating, scary, and stressful. Don’t panic! There are ways to mitigate what has happened to you. If you’ve been arrested, you may still be in a state of shock, and that’s OK. We will walk you through every step to keep you on track for the best result possible.
Drug cases are unique in that each one demands very different needs. A person charged with a THC vape likely has very different needs than a person charged for possession of heroin.
We need to first have a discussion regarding what you can do before you before you ever get to court. If you’ve already had a court setting, that’s OK, too! We can still help you. Fortunately, the justice system moves pretty slowly, so we need to take advantage of the time it takes to go to court.
Drug cases take longer to get to trial than most. This is largely due to the time it takes for the State to do labs on drugs. Most of the lab testing is done by the Texas Department of Public Safety through their crime labs in Garland and Austin. Almost every agency in the DFW metroplex uses these same labs, so the backlog of cases is enormous. Not to mention, COVID-19 made everything more difficult, overloading the labs even more. Many agencies have even started outsourcing to private crime labs to try to speed things up. Due to the backlogs, drug lab testing can take anywhere from six months to a year. Your case won’t even be filed until the labs have been completed, so you should utilize that extra time.
We should start by looking at what you need while ensuring your rights are protected. Depending on your situation, there may be programs we can recommend to help you get clean if that’s a priority. Also, the work you do now will be helpful down the road when the prosecutor is looking at your case.
The consequences for drug charges are harsh. Even though marijuana is legal just a few states away, it’s still prosecuted in Texas. You can buy a THC vape pen at a store in Oklahoma, but it’s a felony here in Texas.

Yes, in Texas, marijuana is still illegal. Depending on how much you were carrying, the consequences can be pretty severe. In fact, drug charges carry other penalties outside of the courts. Your arrest can also affect your driver’s license and bury you in surcharges.
A stated before, marijuana charges depend on the “weight” of the marijuana. The most common are listed here:
If you were in a drug-free zone, the charge is significantly more severe, making the need for legal representation even greater.
It depends—we know, the last thing you want to hear. But in this case, it really does. The Texas Controlled Substances Act categorizes different drugs into a variety of “penalty groups,” each of which has its own range of punishment. Sometimes people actually get arrested for something they were prescribed! It happens all the time.
Once we meet in person, we can build a plan for your specific case.
